Terms and Conditions

1. Provider and scope

Bojoo is operated by OCEAN AMBER LTD, Kantaras 9, Orea Building, Apt 103, 6056 Larnaca, Cyprus, registration number HE 492813, VAT CY60364109W, email hello@bojoo.io ("we"). These terms apply to every use of Bojoo by customers ("you").

Bojoo is intended exclusively for businesses and self-employed persons acting in the course of their trade or profession. Consumers may not use Bojoo. Any terms of the customer that differ from these do not apply.

2. What Bojoo is

Bojoo is an online platform for creating images, videos, voice and music with AI models. Some of these models come from third-party providers. Which models are available may change at any time. We do not promise specific results: AI output can be inaccurate, flawed or unexpected.

3. Access

Your company gets its own area (workspace). The owner of the workspace can invite other people and grant them rights. You keep login details confidential and are responsible for everything done through your workspace's accounts.

4. Credit and prices

Bojoo works with credit that you top up in advance. Before every job, Bojoo shows what it costs. You are charged what the job actually costs. Jobs that fail cost nothing.

To top up, you enter an amount in euros and receive a payment request with bank details and a payment reference. It is valid for one day. As soon as we have received the payment, we add the credit and send you the invoice. The net amount is credited, converted at the European Central Bank rate of the day of the payment request. All amounts are subject to statutory VAT where applicable.

If a payment arrives after the payment request has expired, we still credit it.

5. No refunds, expiry

Credit is a prepayment for using Bojoo. It is not refunded, paid out, transferred or exchanged for money. This also applies if you stop using Bojoo.

Exception: if we discontinue Bojoo or terminate your use without good cause, we refund the credit remaining at that time.

Credit expires twelve months after your last top-up. Every new top-up extends the period for your entire credit. The expiry date is shown in Bojoo next to your credit; we remind you by email about 30 days beforehand. Expired credit is not refunded.

6. Your content and acceptable use

You are responsible for your inputs (text, uploaded images, videos, voices) and for how you use the results. You only upload material you have the necessary rights to, and you obtain the consent of people who can be recognised in it.

In particular, the following is not allowed: unlawful content; content that infringes the rights of others; sexual depictions of minors; depictions of real people without their consent that show them deceptively realistically or demean them; glorification of violence, hate speech and harassment; content intended to deceive or defraud. We may refuse jobs and block content that violates this.

7. Rights to the results

To the extent we hold rights to the results, you may use them freely for your purposes, including commercially. We do not warrant that results are free of third-party rights or can themselves be legally protected.

8. Storage

Bojoo stores your results within the storage limit of your workspace. Keep your own copies of important files. When your use ends, we delete the files after a reasonable period.

9. Availability

We aim for uninterrupted operation but do not guarantee any particular availability. Maintenance, disruptions at third-party providers or force majeure may temporarily restrict Bojoo.

10. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise, our liability is limited to the amount you paid us in the twelve months before the event causing the damage. We are liable for lost profit, indirect damage and loss of data only in cases of intent and gross negligence.

11. Term, suspension, termination

You can stop using Bojoo at any time. We can end your use with 30 days' notice by email. For good cause, for example a breach of section 6, we may suspend access immediately. If your use ends for good cause for which you are responsible, any remaining credit is not refunded.

12. Changes

We may change these terms. We inform you of changes by email or in Bojoo. Every new top-up is governed by the version you agreed to at that time.

13. Law, jurisdiction, language

The laws of the Republic of Cyprus apply. The place of jurisdiction is Larnaca, Cyprus. Should any provision be invalid, the remaining provisions remain valid. These terms exist in German and English; in case of discrepancies, the German version prevails.
